Breaking up is hard to do.
- The legal bar for breaking up companies is high. DOJ would have to demonstrate that the antitrust violations are pervasive and could only be resolved by breaking Live Nation into two companies. Live Nation has argued that prices of tickets are set by artists and would remain high as long as demand is strong while supply is low.
- Many investors expect a settlement between Live Nation and DOJ that requires behavioural changes, rather than structural separation. Live Nation’s share price dropped 16% in April but has rebounded 5% in May.
